Terms of Service

These terms define the rules for creating a Linkallup workspace, documenting field work, managing company users, and sharing project media.

Agreement to these Terms

These Terms of Service (“Terms”) govern access to and use of the Linkallup website, web application, mobile web experience, and related services (the “Service”). By creating an account, accepting an invitation, selecting the registration acceptance checkbox, or using the Service, you agree to these Terms and acknowledge the Linkallup Privacy Policy. If you use Linkallup for a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree, do not create an account or use the Service. The Acceptable Use and Upload Rules form part of these Terms.

Accounts and eligibility

You must be legally able to enter into a binding agreement and use the Service for lawful business purposes. Account information must be accurate and kept current. You are responsible for safeguarding your password, devices, email account, and any activity performed through your account.

Accounts are personal to the named user and may not be shared. Notify Linkallup promptly if you suspect unauthorized access. We may require email verification, security checks, or other reasonable steps before granting or restoring access.

Company workspaces and permissions

Each workspace is associated with one organization. The workspace owner and authorized administrators control invitations, roles, permissions, projects, media, public share links, and member access. Users may access only the organization and information permitted by their assigned role.

The organization is responsible for selecting appropriate owners, administrators, supervisors, standard users, and restricted users; reviewing access regularly; and removing access when a person no longer needs it. Actions taken by an authorized workspace administrator are treated as instructions from the organization.

Customer content and ownership

As between Linkallup and the organization, the organization retains its rights in the photos, videos, files, project details, customer information, annotations, comments, and other materials submitted to the Service (“Customer Content”). Linkallup does not claim ownership of Customer Content.

You grant Linkallup and its service providers a worldwide, non-exclusive, limited license to host, copy, process, transmit, display, and otherwise use Customer Content only as needed to operate, secure, support, and improve the Service, comply with law, and follow the organization’s instructions. This license ends when the content is deleted, subject to reasonable backup, recovery, security, and legal retention periods described in the Privacy Policy.

You represent that you have all rights, permissions, notices, and consents needed to submit Customer Content and allow Linkallup to process it. You are responsible for the legality, accuracy, quality, and appropriateness of Customer Content, including images of people, private property, conversations, and location information.

Using the Service

Linkallup provides tools for field capture, offline upload queues, project organization, maps, annotations, permissions, and public galleries. Internet access, device storage, camera and location permissions, compatible software, and third-party services may be required for some features.

Public share links may be viewed by anyone who receives them. Unless revoked by an authorized user, a share link may remain active. You are responsible for deciding what to share, selecting whether uploader, location, date, customer, or project details are included, and distributing the link only to intended recipients.

Maps, geocoding, timestamps, headings, and location readings can be inaccurate or unavailable and must not be used as the sole basis for safety, navigation, surveying, code compliance, emergency response, payment approval, or legal conclusions.

Fees and paid features

Some Service features or usage levels may require payment. Applicable pricing, storage limits, taxes, billing periods, renewal terms, and cancellation rules will be shown in the order form, checkout page, or plan description presented before purchase. Those commercial terms supplement these Terms. Linkallup will not charge a payment method unless the organization authorizes the purchase.

Suspension and termination

You may stop using the Service at any time. Workspace owners may remove users, and removed users may lose access immediately. Linkallup may limit or suspend access when reasonably necessary to protect the Service or others, investigate suspected misuse, comply with law, prevent material harm, address nonpayment, or enforce these Terms.

Linkallup may terminate an account or workspace for a material or repeated violation after notice when reasonably practical. Certain provisions—including ownership, payment obligations, disclaimers, liability limits, indemnity, and terms that by their nature should survive—continue after termination.

Service disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Linkallup disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or immune from data loss or security incidents.

Linkallup is a documentation tool, not a substitute for professional judgment, required inspections, safety procedures, construction records mandated by contract or law, or an independent backup program. You are responsible for exporting or maintaining additional copies of critical records when appropriate.

Limitation of liability

To the maximum extent permitted by law, Linkallup and its affiliates, suppliers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, data, or use, arising from or related to the Service, even if advised that such damages were possible.

To the maximum extent permitted by law, Linkallup’s total liability for all claims arising from or related to the Service will not exceed the greater of the amount the organization paid Linkallup for the Service during the 12 months before the event giving rise to the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

Business indemnity

To the extent permitted by law, an organization using the Service will defend and indemnify Linkallup and its affiliates, suppliers, and personnel against third-party claims, damages, losses, and reasonable costs arising from the organization’s Customer Content, unlawful use of the Service, violation of these Terms, or infringement of another person’s rights. Linkallup will provide reasonable notice and allow the organization to control the defense, subject to Linkallup’s right to participate with its own counsel.

General terms

These Terms, the Acceptable Use and Upload Rules, the Privacy Policy, and any applicable order form are the entire agreement about the Service and replace prior discussions about the same subject. If an order form conflicts with these Terms, the order form controls for that transaction. Failure to enforce a provision is not a waiver. If a provision is unenforceable, the remaining provisions stay in effect.

You may not assign these Terms without Linkallup’s written consent, except as part of a merger or sale of substantially all relevant assets. Linkallup may assign these Terms in connection with a reorganization, financing, merger, acquisition, or sale of assets. Applicable mandatory rights and venue rules remain unaffected.

We may update these Terms. Material changes will be posted with a new effective date and, when required, presented for renewed acceptance or communicated through the Service or email. Continued use after the effective date of an update constitutes acceptance where permitted by law.
