Copyright and DMCA Policy

Linkallup users may upload and share photos, videos, files, annotations, and other project materials. Users and their organizations must own that content or have permission to use and share it. Linkallup may remove or disable access to material reasonably believed to infringe copyright and may take action against repeat infringers.

This policy describes a notice-and-takedown process based on Section 512 of the U.S. Digital Millennium Copyright Act (“DMCA”). It does not provide legal advice or decide ownership disputes.

A copyright owner or authorized representative who believes material available through Linkallup infringes a copyright should send a written notice containing all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
3. Identification of the allegedly infringing material and information reasonably sufficient for Linkallup to locate it, such as the complete share-link URL, project context, filename, and a screenshot.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Send only copyright complaints through this process. Privacy, safety, or account reports should follow the Acceptable Use and Upload Rules.

Linkallup may ask for missing information, forward the notice to the affected organization or user, remove or disable access to the identified material, preserve relevant records, and take other steps appropriate under applicable law. We may provide the complaining party’s notice and contact information to the person who submitted the content.

Removing or disabling material does not mean Linkallup has decided who owns it. The parties remain responsible for resolving the underlying dispute.

If material was removed or disabled because of a copyright notice and you believe that happened because of mistake or misidentification, you may send a written counter-notice containing:

1. Your physical or electronic signature.
2. Identification of the removed or disabled material and where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
4. Your name, address, and telephone number; a statement consenting to the jurisdiction of the appropriate U.S. federal district court as provided by 17 U.S.C. § 512(g); and a statement that you will accept service of process from the person who submitted the original notice or that person’s agent.

Linkallup may send a valid counter-notice to the original complainant and may restore the material as permitted by law unless the complainant timely notifies us of a court action seeking to restrain the allegedly infringing activity.

In appropriate circumstances, Linkallup may terminate or restrict accounts or workspaces associated with repeated copyright infringement. We may consider valid notices, counter-notices, retractions, court decisions, the user’s history, and other relevant information. We may also remove access to content when required by law or necessary to protect the Service.

Knowingly making a material misrepresentation in a takedown notice or counter-notice may create legal liability. Consider fair use, licensing, ownership, and other defenses before submitting a complaint. If you are unsure, consult a qualified attorney.
